[E-voting] Discrimination against non-EU voters

The Nedap/Powervote electronic voting system will discriminate against
non-EU voters if it is used in the forthcoming European and local
elections.

Consider the example of 2 voters, 1 Irish and 1 Nigerian, both of whom
decide to abstain in the local election.

The Irish voter will be able to select a vote in the European election
and can leave the local election ballot blank. The Nedap/Powervote
system will record a null local election vote in this case. No-one will
know that the Irish voter has abstained in the local election.

A Nigerian who decides to leave the local election ballot blank will
have no choice but to reveal their choice to the official controlling
the machine. The Nedap/Powervote system will not record a null vote for
Nigerians in the forthcoming elections.

Isn't it illegal to treat voters differently on the grounds of their
nationality?
